These Terms and Conditions ("Terms") govern your use of https://thegeneralsportfishing.com/ (the "Website") and any charter or service provided by The General Sport Fishing ("we," "us," or "our"), based in Morehead City, North Carolina, United States. By accessing the Website or booking a charter, you agree to be bound by these Terms.
1. Booking, Deposits & Payments
To secure your charter, a $500 deposit is required at the time of booking. The remaining balance is due on the day of the trip unless otherwise agreed in writing. Once your deposit is processed, you will receive an email receipt and a calendar confirmation of your trip. Your trip is not finalized until you are contacted by the Captain via phone or email.
2. Cancellation & Rescheduling Policy
Each customer will be given the opportunity to reschedule if a cancellation is due to an uncontrollable event such as inclement weather. If a customer wishes to cancel the trip, their deposit will be applied toward another day for rescheduling, unless cancellation is made more than 14 days before the scheduled date. If cancelled more than 14 days prior to the scheduled date, it is at the customer's discretion whether a full cancellation refund is applied or whether the deposit is applied toward a rescheduled date.
The Captain reserves the right to cancel or reschedule any trip due to weather, sea conditions, mechanical issues, or any safety-related concern. In such cases, the customer will be offered a reschedule or a full refund of any deposit paid.
3. Charter Capacity & USCG Compliance
The General is USCG-certified to carry up to six (6) passengers (the maximum allowed by USCG law for our vessel class). For the safety of all aboard, this limit cannot be exceeded under any circumstances.
4. What's Included
Charters include fishing license, bait, ice, mate, and tackle (spinning rods to 130# unlimited and everything in between).
5. What To Bring
Customers should bring sunscreen, sunglasses, boat shoes (no black soles), food and beverages, a camera, and a cooler to take their fish home.
6. Conduct Aboard the Vessel
For everyone's safety and enjoyment, customers and their guests agree to follow the Captain's instructions at all times. The Captain may, in his sole discretion, terminate the trip without refund if any passenger engages in unsafe, illegal, or disruptive conduct (including excessive intoxication, harassment, or willfully ignoring safety instructions).
7. Gratuities
Mates are customarily tipped 15-20% of the charter rate. Our mates are knowledgeable and professional — please feel free to tip above this standard rate at your discretion.
8. Assumption of Risk & Limitation of Liability
Sport fishing involves inherent risks, including but not limited to risks associated with weather, sea conditions, fish handling, hooks and tackle, and use of the vessel. By booking a charter, you acknowledge and accept these risks on behalf of yourself and your guests.
To the fullest extent permitted by law, The General Sport Fishing, the Captain, the crew, and the vessel owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to any charter or use of this Website. Our maximum liability for any claim shall not exceed the amount paid by the customer for the trip giving rise to the claim.
9. Photography & Likeness
From time to time, photographs and videos taken during charters may be used by The General Sport Fishing for marketing, social media, and promotional purposes. By participating in a charter, you consent to such use, unless you notify us in writing prior to the trip that you wish to opt out.
10. Use of Website
You agree to use this Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit anyone else's use of, the Website. All content on this Website is the property of The General Sport Fishing or its licensors and is protected by applicable copyright and trademark laws.
11. Third-Party Services
Our Website integrates third-party services including, but not limited to, a booking calendar provider, payment processor, mapping provider, and analytics provider. Use of those services is governed by their respective terms.
12. Governing Law
These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or any charter shall be brought exclusively in the state or federal courts located in Carteret County, North Carolina.
13. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date above will reflect the most recent version. Continued use of the Website or booking of a charter after changes constitutes your acceptance of the revised Terms.
